MBC's new Wednesday-Thursday drama 'Heading to the Ground', who's main character is played by TVXQ's U-Know Yunho, as had a secure start.
The first episode of 'Heading to the Ground' that aired on the 9th of September scored ratings of 7.2% (TNS Media Korea results) and started of on a 'not-so-bad' start. This rating equated to the ratings of 'Soul' that ended on September 3rd.
'Heading to the Ground' is TVXQ's U-Know Yunho (real name Jung Yunho)'s first attempt at acting and is a love story revolving around Cha Bong-goon (U-Know Yunho), a passionate youth who lacks in everything but soccer, and Kang Haebin (Ara), a girl who has everything she desires but wants to succeed on her own.
All the main characters are people who are faced with trouble but still run towards their dreams and the drama focuses on their fateful meetings.
Unemployed soccer player Cha Bong-goon gets such a job status because his soccer team disbands, and is even dumped by his girlfriend. Agent Kang Haebin gets a talented player taken from her by another agent and has her company contract terminated.
On the other hand SBS Wednesday-Thursday drama 'Swallow the Sun' kept its spot as number one of Wed-Thu series with ratings of 15.5%, and the KBS 2TV drama 'My Fair Lady' tailed behind with 14.4%.

From August 20th through September 10th, DBSK fans put an ad on one page of the HanGyuhReh newspaper.
The advertisement says, "They (DBSK) are not monkeys" along with phrases and such concerning DBSK members' lawsuit with their entertainment agency.
Also in the ad are the words, "Don't ask/try to find out", "Don't speak", "Don't expect answers" with a picture of a monkey tied up. Below that are the words, "DBSK are people with moral rights and decision-making powers."
Three DBSK members Micky Yoochun (Park Yoochun), Xiah Junsu (Kim Junsu), and Youngwoong Jaejoong (Kim Jaejoong) are having some friction with their agency, SM Entertainment. They filed a lawsuit against SM last July 31st to the Seoul Central District Court regarding their unfair contract.

TVXQ fans have reported SM Entertainment to the Fair Trade Committee for the Violation of the Law of Fair Trade.
TVXQ fan site 'DNBN''s staff visited the Fair Trade Committee on the afternoon of the 8th and filed a report against SM Entertainment for the violation of the law of Fair Trade and stated that, "SME abused its power as the 'trader' and had an unlawful transaction with TVXQ."
On the report, fans stated, "When SM Entertainment entered into a exclusive contract with their agency's group TVXQ, they went against Clause 23 subclause 4 of the Monopoly Restriction and Fair Trade Laws (Acts of unfair trade are prohibited) and created an exclusive contract in which unfair trade was inevitable and have been, and still are, carrying out acts of unfair trade."
In this report, fans submitted the main points of TVXQ's exclusive contract that were revealed to the public, the three members' official statement regarding the trial, every single scheduled activity and concert that TVXQ performed in from 2003 until now and information of the exact dates of the members' flights in out and out of Korea.
They also submitted a petition containing 66,625 offline signatures they collected in ten days starting from August 26th.
Fans said, "We are reporting SM Entertainment because, as buyers of TVXQ goods released by the agency, we do not wish to be buyers of goods that were created through an unlawful trade that SM Entertainment has created through the abuse of their power," and "The contract was written so that SM Entertainment would have the upper hand in all situations such as the length of the contract, the income division, the compensation TVXQ would have to pay if the contract was terminated and other aspects of the contract as well."
They stated, "We hope that the Fair Trade Committee finds solutions to these situations that are common amongst celebrities in which the agency seems to be taking too much from the celebrity's profits as soon as possible so that there will never be a dispute like this ever again."
A representative of the Fair Trade Committee said, "This is not something one person at the committee can decide, we must all come together and discuss," and "We will go through the processes of inspections of the reported company to confirm the validity of the report of the violation of Fair Trade and hold many discussions to come to a final decision."
The representative who accepted the report stated, "It is unusual to have a third party submit such a report but anyone is allowed to report any instances, and what they have submitted will help with the investigation," and "I do not know when the results will be out but we are working hard to resolve the situation as quickly as possible."

TVXQ spent an average of three years as trainees, and when military service and the time they spent as trainees are calculated, it can be seen that they must spend over 18 years tied to SM Entertainment and their contract. This is not something that can be accepted in society and the contract that SM Entertainment has with TVXQ can be seen as an unlawful contract.
Income Division
Each member receives only 0.4~1% of income per member per album according to the album sales and do not receive any money from any repackaged goods. This clause was looked over and altered in the early months of 2009 but it still cannot be accepted even after its alteration. This income division shows that SM Entertainment is carrying out acts of unfair trade by taking almost all of the profit that TVXQ earns.
Compensation for the Termination of the Contract
According to the contract, TVXQ must pay three times the amount of investments and twice the amount of money they would have earned had they carried out the entire 13 years of the contract in compensation if the contract is terminated. This clause even applies to when SM Entertainment agrees to end the contract with TVXQ. In truth, with the amount reaching hundreds of billions of Won, it is virtually impossible for TVXQ to terminate their contract.
This is not an acceptable or realistic amount for a contract between an agency and its celebrity, and as this is the same as if SM Entertainment chained TVXQ to the company, the members have no choice but to continue to transact in unfair trade with the agency.

[NEWS] TVXQ Fans Make A Request For Compensation Of Losses To The Korean Consumer Agency

TVXQ fans, who are currently participating in a boycott against all SM Entertainment goods, have filed a request for Compensation of Losses to the Korean Consumer Agency for the indefinite postponement of the 'SM TOWN LIVE 09' concert that was supposed to happen on August 16th.
TVXQ fans went to the Korean Consumer Agency building in Seoul Seocho-gu to submit the request in person. 1249 fans who booked concert tickets online participated in the request.
Not only did TVXQ fans participate, but fans of other SM Entertainment singers such as SHINee, Super Junior and Girls' Generation joined in as well.
One representative of DNBN, who led this request to the Korean Consumer Agency, criticized SME by saying, "TVXQ stated numerous times that they would attend this concert to keep their promise with their fans, and SM Entertainment also stated that the concert would go through as planned regardless of the exclusive contract dispute. However, one week before the concert date, SM Entertainment indefinitely postponed the concert absurdly claiming that the singers would not be able to show their unity and friendship because of what was happening with the trial."
The fans are demanding that SM Entertainment release an official apology and return at least 10% of the ticket price as compensation for the "Physical and emotional pain the fans suffered through due to things such as the lost ticket cost, time and anticipation for the concert."
TVXQ fans said, "This is not only a problem between fans and an entertainment agency, this is also a problem between consumers and a company," and "We are not doing this just because we want our money back, we are doing this because we as consumers cannot sit idly by while a company comes and strips us of our rights."
They also showed their disappointment and discontent by stating, "We consumers, who were the ones who lost money because SM Entertainment basically canceled the concert after all bookings for tickets were completed, at least tried to strike up talks with their side, but SM Entertainment completely ignored all of our attempts."
TVXQ fans sent SM Entertainment a certification of contents on the 2nd that requested compensation for the canceling of the concert and was sent by those under the name 'SM Concert Victims'.
They stated, "This is not the first time SM Entertainment has postponed a summer concert. In 2006, the agency postponed the 'SM SUMMER TOWN FESTIVAL', not because of problems with ticketing or funding, but because they wanted to 'bring a higher quality performance' and because of bad weather conditions," and "Because SM Entertainment has been toying with its consumers, it is now time to put an end to this vicious practice."
The Korean Consumer Agency worker who accepted to look over the request stated that, "We will be inspecting this case in the '50 complaints or more' section," and "When a staff is designated to oversee the process, we will investigate the happening closely and will settle on a just settlement for the victims of the situation."
One representative stated, "We do not receive complaints at such a large scale usually so we cannot predict how long this process will take," and "But compensation and consequences will be decided after SM Entertainment proves to the Korean Consumer Agency that they had no choice but to cancel the concert."
SM Entertainment released an official statement on their website last month stating, "We are very sorry for disappointing the fans who have waiting a long time for this concert," and indefinitely postponed the 'SM TOWN LIVE '09' and set up refund methods.
